The Rome court said the 12 migrants detained in Albania must return to Italy

The 18th section of the civil court of Rome did not validate the detention of the 12 migrant people in the new centers in Albania.

The forced transfer to Albania

In recent days a migrant boat had been intercepted in the Mediterranean Sea by the Italian navy and, after a quick identification, in 16 of nationality of Egypt and Bangladesh considered “not vulnerable” and coming from “safe countries” they had been forcibly relocated in the new Italian detention centers in Albania, wanted by Meloni government for a total cost of 670 million euros in five years.

In the following hours, four of them had already returned to Italy, because it was discovered that they did not comply with the requirements necessary for detention in Albania:there were two minors, two others were vulnerable because he is in precarious health conditions.Subsequently the territorial commission analyzed the asylum requests of the remaining 12, with a speeded up procedure which required a few hours instead of the usual months needed to thoroughly investigate the individual's condition with interviews and other procedures.The asylum requests were all rejected and the asylum phase was therefore opened for the 12 migrant people detention with a view to repatriation.

The stop to detention by the Rome court

Now the civil court of Rome has ruled on the issue, rejecting the detention of the 12 people, establishing that their countries of origin are “unsafe countries”, contrary to what was established by Italy.What weighed was the pronunciation of the European Court of Justice of the European Union at the beginning of October, who had contested the way in which Italy classified safe countries.For Italy, a country could be considered safe that in certain regions, and in certain aspects, was unsafe.For the European jurisprudence however, when a country has unsafe characteristics, it should be considered completely unsafe.
