ROME - The Court of Justice of the European Union declared in a ruling that the Italian ban on the marketing of disposable bags made from non-biodegradable and non-compostable materials is contrary to a 1994 European directive.The EU Court of Luxembourg was consulted by the Lazio Regional Administrative Court Papier Mettler Srl, a company operating in the distribution of paper and plastic packaging.The company requested the annulment of decree n.73 of 2013 which prohibits the manufacture of such plastic bags intended for the collection of goods that do not meet certain technical characteristics.This regulation, we read in a note, "can however be justified by the objective of guaranteeing a higher level of environmental protection, provided that it is based on new scientific evidence relating to environmental protection that emerged subsequent to its adoption. of a Euro-unitary law, and on condition that the State communicates to the Commission the measures envisaged and the reasons for their adoption".
